The Senate is set to vote on a bill today that would define the whole of the United States as a “battlefield” and allow the U.S. Military to arrest American citizens in their own back yard without charge or trial.
“The Senate is going to vote on whether Congress will give this president—and every future president — the power to order the military to pick up and imprison without charge or trial civilians anywhere in the world. The power is so broad that even U.S. citizens could be swept up by the military and the military could be used far from any battlefield, even within the United States itself,” writes Chris Anders of the ACLU Washington Legislative Office.
Under the ‘worldwide indefinite detention without charge or trial’ provision of S.1867, the National Defense Authorization Act bill, which is set to be up for a vote on the Senate floor this week, the legislation will “basically say in law for the first time that the homeland is part of the battlefield,” said Sen. Lindsey Graham (R-S.C.), who supports the bill.
The bill was drafted in secret by Senators Carl Levin (D-Mich.) and John McCain (R-Ariz.), before being passed in a closed-door committee meeting without any kind of hearing. The language appears in sections 1031 and 1032 of the NDAA bill.
“I would also point out that these provisions raise serious questions as to who we are as a society and what our Constitution seeks to protect,”Colorado Senator Mark Udall said in a speech last week. One section of these provisions, section 1031, would be interpreted as allowing the military to capture and indefinitely detain American citizens on U.S. soil. Section 1031 essentially repeals the Posse Comitatus Act of 1878 by authorizing the U.S. military to perform law enforcement functions on American soil. That alone should alarm my colleagues on both sides of the aisle, but there are other problems with these provisions that must be resolved.”
This means Americans could be declared domestic terrorists and thrown in a military brig with no recourse whatsoever. Given that theDepartment of Homeland Security has characterized behavior such as buying gold, owning guns, using a watch or binoculars, donating to charity, using the telephone or email to find information, using cash, and all manner of mundane behaviors as potential indicators of domestic terrorism, such a provision would be wide open to abuse.
“American citizens and people picked up on American or Canadian or British streets being sent to military prisons indefinitely without even being charged with a crime. Really? Does anyone think this is a good idea? And why now?” asks Anders.
The ACLU is urging citizens to call their Senator and demand that theUdall Amendment be added to the bill, a change that would at least act as a check to prevent Americans being snatched off the streets without some form of Congressional oversight.
We have been warning for over a decade that Americans would become the target of laws supposedly aimed at terrorists and enemy combatants.Alex Jones personally documented how U.S. troops were being trained to arrest U.S. citizens in the event of martial law during urban warfare training drills back in the 90′s. Under the the National Defense Authorization Act bill, no declaration of martial law is necessary since Americans would now be subject to the same treatment as suspected insurgents in places like Afghanistan and Iraq.
If you thought that the executive assassination of American citizens abroad was bad enough, now similar powers will be extended to the “homeland,” in other words, your town, your community, your back yard.

One week you're singing the praises of the Marines and thanking our service men and women, the next you are fear-mongering with the likes of Alex Jones who clearly loathes the United States military! I would hope you read the bill for yourself. Especially the part anonymous posted above. While I don't agree with the bill, I am more frustrated that so many 'Patriots' who claim to be thankful of the freedoms they have due to the blood sacrifice of our military members are so quick to turn on those same heroes when any piece of legislation is on the table. Either you trust in the inherent goodness of our military
    members or you don't. I, for one, being a veteran and being married to a Godly, loving, honest military member know that even IF this bill states what you have assumed (from Alex Jones) the overwhelming majority of our selfless, courageous military members would NOT enforce this type of order. They would
    deem it unlawful. If you think those Marines you raved about last week would
    Actually do this then next year when your family is invited to the Marine Corps
    ball with all those Marines you obviously think would carry out these orders
    maybe you should forgo the photo op and simply decline the invitation. I mean
    really, how could you trust that those fine Marines aren't going to cart you and
    yours off to a FEMA camp after the first waltz?! You're no worse than the
    elected officials who show up for photo ops with the troops in Afghanistan and
    Iraq on Thanksgiving and Christmas! SHAME ON YOU!

    Because of the wide variability of interpretation possibilities alone, it is clear that either the
    Justice Dept. would be in control of civilian internments, or that The Defense Dept. would be in control.

    Split hairs if you wish, it is the entire concept of this bill to intern US citizens, who could potentially be mislabeled due to their political affiliations or organizational affiliations, and could be deemed to be "terror extremists". what is now a constitutional protection by our judicial legal system, to have to prove guilt, would no longer matter! Actions taken against them, would now become legal and thus the potential implication of tyrannical abuse!

    Give the US Justice dept. an inch, and they take a mile of our freedoms away while claiming to do so, "to protect us".
    We still have open borders where terrorists enter! And they're trying to federally mandate that the states have no right to protect themselves by closing off their own state borders!

    Our judicial system has served this citizenry for nearly 400 years. Why, now, do we need to create a separate caveat just to address the charging, apprehension and arrest, and prosecution process of a bonafide US homegrown terrorist?

    I think the Udall clause is just a bandaid fix approach in attempts to try to make this bill more palatable for passage.

    The whole addition of internment powers given to the Justice dept. or to the Defense dept to intern US citizens, into the main bill, needs to be pulled and removed from the National Defense Bill!
    Stop blackmailing our military into accepting this unconstitutional duty!



    If our brave soldiers military legal hands have been tied by our Justice Dept, or by the President, to actually prosecute terrorists from abroad, then, we need to look at those negative consequences that have been placed on them by the UN and NATO forces laws.

    Please act now. Contact your state Senators. Consider the consequences this could have to our citizen freedoms!

    No - the shame is not on me! Our elected officials should be ashamed - not out military and not me. I have the utmost respect for our military. The Marines are the finest group of people that I have ever had the privilege of knowing. Unfortunately, it is not the man on the ground making the decisions, and although most would balk at detaining an American citizen, they would in fact be being told that the citizen they were detaining was a terrorist and that they were doing the "right" thing.

    It takes men of great conviction and courage to defy orders. I want to stop this before we put our men and women of the military in the position of HAVING to disobey orders. I don't want your husband to EVER be in the position of having to choose between moral and legal. It is because I respect the military that I believe we need to nip this nonsense in the bud.

    Thank you for writing. I'm glad to know there are men and women of courage fighting for the freedoms of our country.

  7. No dictator and or evil evolution of 'government' has ever lacked for willing citizens to enforce law of this nature. Human kind will always have a percentage that will step up and perform the most horrenduous act against those they are given authority over. If there is shame or 'blame' to be had assign it to those people and those alone. Whats the olde saying.... Evil will triumph when good men do nothing.... or words to that effect.

    Did any of the rest of you in here notice the shift in the tone of the conversation? Have any of you been pushed far enough as yet? Have any of you in here decided at what point you will actually defend your own citizenship?

    This media is not free of eyes that do not care for this sort of conversation. Posting the truth and other such ideas is getting rather.... risky!

    I have studied evil regimes. One common denominator they all have.

    A short lifespan.

    Nazi Germany 1933-45
    Soviet Russia 1918-91
    (There are many others throughout history)

    If this country were to fall into the abyss of evil, it would not last long. Freedom is a natural human trait and in America a God given right.

    If some president became another Hitler or Stalin, I predict the Pentagon would pull a military coup on the civilian leadership. At that point my concern would be about immediate elections and restoring the Republic. I really believe most military personal would lawfully and respectfully refuse an unjust illegal order.
    The manure can roll uphill just as easily as it can roll downhill (we used to say that in the military)
    As soon as troops are given illegal orders to open fire on unarmed civilians (on American soil), I believe most troops would turn the weapons around and point them at the idiot giving the unlawful and clearly unconstitutional order. Evan if troops were given the order in Afghanistan they would question the order on firing on potential non-combatants.
    Some troops will go to the "darkside of the force', however most are still human and still American.

    The best way to deal with the idiots that screw things up in Washington is to vote everyone of the dirtbags out.

  12. My, this post has certainly brought out some diverse and passionate responses!

    I watched a movie called "Good" last year. I hesitate to mention it here because it is not one that I would recommend to anyone. I watched it because it studies the question that we are discussing. How do reasonable people turn upon themselves or a segment of themselves. How do you make people do unimaginable things to one another. It wasn't as good (sorry about the pun) as I hoped it would be, but it did a decent job. A German who just wanted to get along, not make any ripples in the changing social and political climate. He finds himself maneuvered into service in Hitler's Army, and one day he finds himself delivering Jews to a concentration camp. He looks around and realizes what he has become.

    I'm no fan of the ACLU, but I hope they make a huge set-to over this. I live in TX, so my two senators are probably all for this bill. I'll write anyway, but I think the dye is cast. Unless we can get some responsible leadership in the White House, and I don't see any on the horizon, we will continue to receive the LORD's discipline.

    Thank you for your insightful blog. I really enjoy it since I am on a new and similar path. I hadn't heard about this bill and I thank you for sounding the alarm. Like you, I believe in our military and hate to see them put into this position. Our problem in this country is our leadership. May God have mercy on us!

  15. Those of you placing your hope on the ballot box and the inate goodness of the American citizen (and military) had better do a fast course on history and human nature... you're about to crash headlong into reality.

    The ballot box got us here. Human beings are depraved and sinful by nature. Doesn't make any difference if they are Repubs or Dems, civilians or military. And America is not the country you think it is.

    The people asked for a king and God gave them one. Then they tried to recreate His Garden but this time they kept Him out. And He let them...

  16. Just finishing a book called "Enemies Foreign and Domestic". This book has been bothering me more than any other book of its type that I have read over the years, because I have been feeling that it is truer than I could believe. And now this article.

    I could just sit down and cry!

    I'm getting way too old to be on the firing lines anymore. My eyesight is going, I'm overweight, I am trying but will probably never make Marksmen status (at least I am a good cook), I am a veteran but from an era when we women were told to "stay at home and tend to the home fires while the men went to war". For the last 20-30 years I've felt that the only way to control congress was term limits on everyone (one term, Period!), but no one seems to agree that I know.

    I could just cry!

    the ballot box got us here, and the ballot boxes will get us out as well!
    This country VOTES. Every citizen has a choice and a vote.
    The politician is our representative and servant.

    When that role becomes corrupt, or changes, and they no longer wish to serve the constitutional laws, which this country was founded upon, then it's time for that servant to GO!

    Our number one contribution that each of can do now to make a huge difference, is to inform others, of how our constitutional freedoms, and liberties won for us, through the US Constitution and Declaration of Independence, and the Right to worship God, are dwindling!

    Those are what makes this nation so valuable from all the others on this earth.

    We as citizens have been asleep at our watchposts for too long! We've become complacent and much too over indulgent in our Trust extended to our house and senate representatives. We've allowed the creeping expectation of laws advocating to and to the protections afforded at establishing "diversity" to become a template of tolerance and socialistic acceptance which has morphed into a US citizen mentality of "walk on me and my rights, it's okay, if it will make everyone else feel accepted". "what's mine is yours" Kumbaya.

    We've done this all to ourselves by our passivity. We have eaten what we were fed.
    We've gotten what we allowed the mass populace to REQUEST from their government.
    Subservience!
    "Take care of me. You're responsible. I give up my rights, and you're in control, just take care of me!

    Now, it's time to stop this ball from rolling any further.

    When you lose a freedom, it's darn hard to get it back! But, it's doable!, by removing the corrupt and by participating, and by voting in servants of government who actually "represent" you and your households value systems!

    This won't happen by wishing it! It will only happen by getting involved in your local community
    campaigning.

    And, if there is NO qualified candidate, put yourself and your name on that ballot, as a write in! Run for office!

    There will be no one to blame but ourselves, if we allow this "mis-representation" to continue!

    No - to the best of my knowledge it has not. Truthfully, I have not read the bill, nor do I know what the verbage is. You must check it out for yourself and assess how threatening you believe it to be. Of course, there are conflicting reports. I think this is very threatening even if there is the slightest possibility the military could be directed to policing actions against their own countrymen.

  22. May I suggest that those who accuse people of turning our backs on our Military take a look at http://www.oathkeepers.org.

    If you are in the military and law enforcement please join and be aware of the motivation behind all that comes from the "leaders" in charge.

    The Military will be used by our corrupt politicians, if not now...very soon. Our military personnel along with law enforcement have taken an oath to uphold our Constitution.

    Our so-called "leaders" starting at and even above the top Commander-in-Chief have destroyed much of our Constitution and hell-bent on destroying what is left of a once great country.

    This is only the camels-nose-under-the tent. As with Obamacare, this too will be changed and re-arranged, subtly over time to look like it will eventually become - another tool at the hands of the great evil in this country to control the masses.

  23. 1) One thing that I haven't seen on this post or its comments is that with this line of thinking also comes the possibility of UN "peacekeepers" on our countryside.

    Sure many say it'll never happen, but we also said our military could never be turned against us.

    2) We've now had at least one generation of kids that were raised on video games being desensitized to killing whatever comes across the video screen. Throw that in with some training about following orders, and not the Constitution, and we have a recipe for a new round of "Hitler Youth" graduating to SS shock troops.

    3)Also, we've been accepting Muslims into our military for quite awhile. One has to question having someone in our military who belongs to a religion where there are well over a hundred passages in their so-called bible that teach that killing the non-believing infidel is not only permitted but commanded. We watched the Fort Hood massacre happen, just how many of these people are in our military? Wouldn't they think that rounding up we infidels be the grandest thing?

    I hope and pray that none of this ever comes around, but I look out and see all our SWAT teams kicking in doors (and in some cases killing people like that Marine down in Arizona) and violating our Constitutional rights simply because it's "legal" and I don't have much hope for our future.

    Today, the Senate voted 38-60 to reject an important amendment (Udall clause)to the National Defense Authorization Act (NDAA) that would have removed harmful provisions authorizing the U.S. military to pick up and imprison without charge or trial civilians, including American citizens, anywhere in the world. The amendment offered by Sen. Mark Udall (D-Colo.), would have replaced those provisions with a requirement for an orderly congressional review of detention power.

    The Secretary of Defense, the Director of National Intelligence, the Director of the FBI and the head of the Justice Department’s National Security Division have all said that the indefinite detention provisions in the NDAA are harmful and counterproductive, and the White House has issued a veto threat over the provisions.

    We’re disappointed that, despite robust opposition to the harmful detention legislation from virtually the entire national security leadership of the government, the Senate said ‘no’ to the Udall amendment and ‘yes’ to indefinite detention without charge or trial.

    The next opportunity to remove the harmful detention provisions from the bill will be when House and Senate conferees meet in conference committee next week.

    If the conference committee fails to remove the detention provisions, President Obama should follow through with his veto threat. Today’s vote on the Udall amendment shows there’s more than enough opposition to these provisions to sustain a veto. Stay tuned for more information.

    UPDATE: The vote changed from 37-61 to 38-60. The final vote is reflected in the post.

    Senate Passes Controversial Defense Bill
    The NDAA, passed by a Senate vote of 93 to 7, and virtually states that all of the United States may be considered a battlefield, and therefore the American military is permitted to indefinitely detain any American perceived to be a threat.
    Please read the entire Bill.

    SEC. 1031.(e) Authorities-
    Nothing in this section shall be construed to affect existing law or authorities, relating to the detention of United States citizens,
    lawful resident aliens of the United States or any other persons who are captured or arrested in the United States.

    SEC. 1032.(b)(1) UNITED STATES CITIZENS-
    The requirement to detain a person in military custody under this section
    does not extend to citizens of the United States.


    This tramples over the Constitutional protections by evoking an “exception” as the new rule. This exception step has been the case in point used in nearly every despotic takeover of it's citizenry, in modern history.

    If it's acceptable for your troops to detain "suspected terrorists" (random people) indefinitely without trial in Afghanistan then it's acceptable for them to detail "suspected terrorists" (random people) indefinitely without trial in America.

    The injustice here is indefinite internment without real evidence or trial, not it's extension to America.
